Is this case likely to be successful in application for UK Indefinite stay?

The woman arrived in the Uk in 2003 on a student visa and in 2006 she managed to change it to a two year HSMP visa. in 2008 she got a further three years on HSMP and would have been a shoo in for permannent residency. But she was diagnosed with an illness that has left her partly disabled and unable to work in the past 2 years. however, she has not been on benefits and her husband (on a spouse dependant visa) works and supports the family. do you think his economic activity will be regarded instead of hers? is the application (in September 2011) for indefinite leave to reamin likely to be succesful?
